After both spouses have completed Step 4 (Legal Review) and signed their legally binding Separation Agreement, they are eligible to proceed with the divorce application. At this point, Separation Pathways provides access to a Divorce Application Package, which includes assistance from a licensed paralegal who guides the couple through the required paperwork and court procedures.

During this step, the paralegal meets with both parties to complete the divorce application forms, ensuring that the information is accurate and that all necessary supporting documents are included. The goal is to simplify what can otherwise be a complex legal process and to help couples avoid common filing errors. This service is particularly valuable for spouses who have already resolved issues such as parenting arrangements, support, and property division through mediation and legal review.

Once the application is finalized, the paralegal assists with submitting it to the appropriate court for processing and approval. The court then reviews the materials and, if all legal requirements have been met, grants the divorce order, formally ending the marriage. Step 5 therefore represents the final stage of the Separation Pathways journey, transitioning couples from a legally documented separation to a legally recognized divorce.

How Does the Divorce Application Process Work?

1. Complete Your Separation Agreement

For clients following the Separation Pathways process, Step 5 normally begins after Step 4 – Legal Review.

Your mediated Memorandum of Understanding is converted into a Separation Agreement, each spouse receives independent legal advice, and the final agreement is signed.

2. Meet With a Licensed Paralegal

A licensed paralegal works with you to collect the information required for your divorce application and complete the appropriate forms.

This gives you professional assistance with the administrative court process rather than having to navigate the paperwork alone.

3. Prepare the Divorce Application

Depending on your circumstances, an Ontario divorce may proceed as a joint divorce or a simple divorce.
