The Value of Financial Disclosure in Separation Agreement

When ending a marriage or common-law relationship, the first legal step is signing a Separation Agreement. This is a crucial process, as the word “Agreement” implies that both parties must make informed and considered decisions about their future.

Aside from child-related matters, a Separation Agreement primarily addresses two key issues:

Property (what you own and owe)
Support (the income available for spousal and/or child support).

For this process to work effectively, full and complete financial disclosure is essential. Both parties must be transparent about their assets, debts, and incomes. With this information, a financial professional, lawyer, or mediator experienced in financial matters can create an accurate analysis of each party’s financial situation.

How Financial Analysis Supports Your Decisions

The financial analysis typically begins with a “Legal Model”—an estimate of what each party might be entitled to based on current laws. Afterward, a similar analysis is conducted based on the proposed terms of the Separation Agreement. This allows both parties to compare their potential legal entitlements with the terms they are agreeing to, helping them make well-informed decisions about their financial future.

When it comes time for each party to seek Independent Legal Advice (ILA), their lawyer will ask if they understand the difference between their legal entitlement and what they have agreed to in the Separation Agreement. The financial analysis provides clarity on this critical point.

Why Independent Legal Advice Matters

For a Separation Agreement to hold up over time and withstand potential legal challenges, it’s essential that both parties have received independent legal advice. They must also demonstrate a clear understanding of the financial implications of their decisions, particularly in relation to their legal entitlements.

In some cases, the financial information may be straightforward, but other times, there are more complex situations to consider, such as:

Property Considerations:

  • Assets brought into the marriage
  • Inheritances
  • Business valuations

Income Considerations:

  • Cash incomes
  • Manipulation of income through private companies
  • Irregular bonuses

Experienced financial professionals or lawyers are well-equipped to address these complexities.

Long-Term Financial Planning

Another benefit of working with an experienced financial professional is that they can help integrate potential settlement options into a longer-term financial plan. This can provide insight into how short-term financial decisions might impact long-term goals, including retirement planning.

The Value of Joint Financial Professionals

“One final recommendation is for both parties to consider using an independent financial professional jointly. This collaborative approach can minimize back-and-forth discussions, reduce legal costs, and often result in faster, more cost-effective solutions.” – shares Doug Lamb, the Divorce Financial Advisor.

By committing to full financial disclosure and seeking appropriate professional advice, both parties can create a Separation Agreement that is fair, transparent, and legally sound — setting the stage for a more stable financial future.
